1. About these Terms
These Terms of Service ("Terms") govern your use of the Wimbi mobile application (the "App"). The App is provided by Stefano Ferrari, Via Viappiani 40, 42014 Castellarano (RE), Italy ("Wimbi", "we", "us"). By using the App, you agree to these Terms and our Privacy Policy.
If you obtain the App from the Apple App Store, Apple's Standard End User License Agreement and applicable store terms also apply. Mandatory rights under applicable law prevail where they cannot be excluded.
2. The App
Wimbi helps users discover, organize, and play online media and maintain a personal library on their device. Media, artwork, metadata, lyrics, and other material available through the App may be supplied by third-party services or their respective rights holders. Wimbi does not grant rights to third-party material.
3. Third-party services
Some features use YouTube API Services. By using Wimbi, you agree to be bound by the YouTube Terms of Service.
Third-party services may change, restrict, or discontinue their content or functionality at any time. Wimbi is not affiliated with, sponsored by, or endorsed by third-party providers unless expressly stated, and their own terms and policies apply to your use of their services.
4. Your library
Your Wimbi library is stored on your device and is not a guaranteed backup. You are responsible for keeping separate copies of anything important and for any names, descriptions, or other text you add to the App.
5. Permitted use
You may use the App only for lawful, personal, and non-commercial purposes. You must not use it to infringe the rights of others, obtain unauthorized access to any service or data, interfere with the App or a connected service, or use third-party material beyond the rights granted by its provider and applicable law.
6. Intellectual property and reports
The Wimbi name, design, software, and original App materials are owned by us or our licensors and are protected by applicable law. We grant you a limited, personal, non-exclusive, non-transferable license to use the App in accordance with these Terms. Third-party material remains the property of its respective rights holders.
To report a rights concern, contact support@wimbi.app with enough information to identify the material and the basis of your claim. Where the material is controlled by a third party, we may direct you to that provider.
7. Availability
The App and third-party content may change or become unavailable. We do not guarantee continuous, error-free operation or the permanent availability of any item or feature. We may update or discontinue the App, subject to any notice required by law.
8. Disclaimers and liability
To the extent permitted by law, the App is provided "as is" and "as available". Wimbi is not responsible for third-party content or services or for indirect, incidental, special, or consequential loss arising from them or from use of the App. Nothing in these Terms excludes or limits liability, warranties, or consumer rights where doing so would be unlawful.
9. Governing law
These Terms are governed by the laws of Italy. If you are a consumer, this does not deprive you of mandatory protections or competent forums available under the laws of your country of residence.
10. Changes
We may update these Terms as the App or applicable requirements change. We will update the date above and provide any additional notice required by law.
